Terms of service

Draft: pending legal review

These terms are the agreement between you and pairterm (“we”, “us”) for the use of pairterm.com. By creating an account, buying hours or starting a session you accept them.

1. The service

pairterm is a hosted tmate and zmate service. You point your client at ssh.pairterm.com, and your peers join over SSH through the same address. We relay the terminal session between you and your peers.

2. Your account and your keys

You need an account to host sessions. Give us true information and keep your login safe. API keys and SSH keys are credentials: keep them secret, do not share them, and delete a key you think has leaked. You are responsible for what happens under your account and keys until you revoke them. Tell us at once if you suspect misuse.

3. Prepaid hours

  • You buy session-hours in packs, paid in advance through Stripe Checkout.
  • Sessions draw hours down by the minute. If you run several sessions at once, each one counts.
  • Hours do not expire.
  • The price of an hour can change for packs you buy later. A change never affects hours you already bought.
  • Hours are for your own use. They cannot be exchanged for money, except as set out under refunds.

4. When your hours run out

When your balance is nearly used up, your running sessions get warnings. When it reaches zero, your sessions are closed and you cannot start new ones until you buy more hours. Save your work in time: a closed session ends your terminal.

5. Refunds

  • Within 14 days of buying a pack, you can ask for a refund of its unused hours, at the price per hour you paid for that pack.
  • Hours already used are not refundable. Hours are used from the oldest pack first.
  • After 14 days there are no refunds.
  • At checkout you agree that the service starts immediately, and you acknowledge that this limits your right of withdrawal as a consumer for the hours you use.
  • A refund also returns the tax that was charged on the refunded part.

6. Taxes

Prices exclude tax. Value added tax, sales tax or a similar tax is calculated from your billing address, added at checkout and shown before you pay. If you give a valid tax ID, the tax rules for businesses apply where they allow it.

7. Chargebacks and disputes

If you dispute a payment with your bank or card issuer, we freeze your account while the dispute is open. Please write to us first: we would rather fix a problem than fight a dispute. If a dispute is decided for you, we may close your account and take back the hours that the payment bought.

8. Acceptable use

You must not:

  • use tunnels as an open relay or proxy for traffic that is not your own terminal session;
  • abuse the service, our systems or other people, or try to get around a limit;
  • send, store or share illegal content;
  • scan, attack or probe other systems or networks, or use a session to do so.

Each account has limits on concurrent sessions and on bandwidth. We may change the limits and may slow down or close a session that goes beyond them.

9. Service level and privacy of sessions

The service is provided “as is” and “as available”. We give no guarantee of uptime. A session can end when a server fails or is restarted, and the hours used up to that point still count. We do not record or inspect the content of your terminal sessions beyond what is needed to operate the service, such as routing, limits, billing and abuse prevention. Our privacy page says what else we keep.

10. Suspension and termination

You can stop using the service at any time. We may suspend or close your account, with or without notice, if you break these terms, if the law requires it, or if your use puts the service or other people at risk. If we close your account for no fault of yours, we refund the unused hours of packs you bought. If we close it for a breach, we do not.

11. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost data, lost profit or lost business that comes from using the service. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits a liability that the law does not allow us to limit, or your rights as a consumer under mandatory law.

12. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict of laws rules. The courts of Colorado have jurisdiction, except where mandatory consumer law gives you the right to go to the courts of your home country.

13. Changes to these terms

We may change these terms. We tell you of a material change by email or on the dashboard at least 30 days before it takes effect. If you do not agree, you can stop using the service and ask for a refund of your unused hours. A change never touches hours you already bought, or their price.
